TERMS AND CONDITIONS OF THE INSTAGRAM CONTEST "Dream Journey with Van Der Moon"
§ 1. GENERAL PROVISIONS
The organizer of the contest (hereinafter referred to as the "Contest") is Vitberg Jacek Sikora with its registered office at ul. Borelowskiego 29, 33-300 Nowy Sącz, NIP (Tax ID): 7341006509 (hereinafter referred to as the "Organizer"), owner of the trademark "Van Der Moon". The Contest is conducted on the social networking site Instagram on the profiles: @vandermoon (instagram.com/vandermoon) @vanderbenc (instagram.com/vanderbenc) The Contest is not organized, administered, supported, or sponsored by Instagram (Meta Platforms, Inc.). Instagram bears no liability towards the Contest participants in connection with its organization and conduct. The Organizer declares that the Contest is not a game of chance, raffle, mutual bet, promotional lottery whose result depends on chance, nor any other form provided for in the Act of 19 November 2009 on gambling games. The selection of winners is made based on a qualitative assessment (creativity) performed by the Contest Commission. Supervision over the correctness and conduct of the Contest is exercised by the Organizer.
§ 2. CONTEST PARTICIPANTS
Participants in the Contest may be adult natural persons possessing full legal capacity, being consumers within the meaning of Art. 22¹ of the Civil Code, holding an active and public account on Instagram (hereinafter referred to as the "Participant"). By taking part in the Contest in the manner specified in § 5 section 1 of the Terms and Conditions, the Participant declares that they have read the Terms and Conditions and accept their provisions. Employees and associates of the Organizer and members of their immediate families may not participate in the Contest.
§ 3. PRIZES
The Contest provides for 4 (in words: four) main prizes for 4 different Winners. The prizes in the Contest are:
1st Place: Moon Box Titan Gray Cabinet / 95cm / at the angle selected by the winner AND a one-time discount code valued at 20% for any products in the online store vandermoon.com. 2nd Place: Moon Box Tebe Gray Cabinet / 95cm / at the angle selected by the winner AND a one-time discount code valued at 20% for any products in the online store vandermoon.com.
3rd Place: Moon Box Cabinet – model: Ersa Gray / Adventure / 90cm / 103° AND a one-time discount code valued at 20% for any products in the online store vandermoon.com. 3rd Place: Moon Box Cabinet – model: Ersa Gray / Adventure / 90cm / 103° AND a one-time discount code valued at 20% for any products in the online store vandermoon.com. The prizes are in-kind and are not exchangeable for cash or prizes of another type. The Winner is not entitled to transfer the right to the prize to third parties.
§ 4. PLACE AND DURATION
The Contest runs from 14.01.2026 (from the moment the contest post is published on Instagram) until 21.01.2026 at 23:59. The results will be announced within 5 business days from the end of the Contest in the form of a comment under the contest post on Instagram or on the Organizer's Instastory.
§ 5. RULES AND CONTEST TASK
To take part in the Contest, the Participant must complete the Contest Task consisting of performing all of the following actions jointly:
a) Following the profile @vandermoon on Instagram;
b) Following the profile @vanderbenc on Instagram;
c) Publishing a comment under the contest post, in which the Participant tags a minimum of 3 (three) people and answers the question: "Where would you take your friends camping?". The comment must be the original work of the Participant. To avoid randomness, the Jury will evaluate the attractiveness and creativity of the provided answer. The Participant may add an unlimited number of comments, however, only comments containing tags of a minimum of 3 people (friends of the Participant) will be evaluated in the Contest. It is forbidden to tag fictitious accounts, brand accounts, or persons who are not friends of the Participant (so-called spamming). Comments containing such tags and the Participant tagging the indicated accounts will be excluded from the Contest.
§ 6. SELECTION OF WINNERS (CONTEST COMMISSION)
For the purpose of selecting the Winners, the Organizer appoints a Contest Commission (Jury). The Contest is not a game of chance. When selecting winners, the Commission does not use any devices or randomizing mechanisms. The criteria for evaluating contest entries are: a) Creativity and attractiveness of the answer to the contest question; b) Compliance with the theme of the Contest and the Van Der Moon brand; c) Correct execution of all tasks described in § 5 section 1 above (including following both profiles). The Commission will select 4 Winners, to whom it will award prizes for 1st, 2nd, and double 3rd place respectively. The decision of the Commission is final.
§ 7. CLAIMING PRIZES
Winners will be notified of their win by being tagged in the result post on Instagram or on Instastory and (if privacy settings allow) in a private DM message. A condition for receiving the prize is for the Winner to contact the Organizer via private message (DM) on the profile @vandermoon within 3 days of the announcement of results and provide the data necessary for shipping the prize: a) First and last name; b) Shipping address; c) Phone number for the courier; d) E-mail address. Failure to contact by the Winner within the indicated period means resignation from the prize. In such a case, the Commission may award the prize to another Participant. Prizes will be sent at the Organizer's expense within 30 days of receiving the complete address data.
§ 8. PERSONAL DATA (GDPR)
The Controller of the Participants' personal data is Vitberg Jacek Sikora, address: ul. Borelowskiego 29, 33-300 Nowy Sącz, NIP: 7341006509, contact e-mail address regarding personal data protection: shop@vandermoon.com. Personal data is processed exclusively for the purpose of conducting the Contest, selecting Winners, considering potential complaints, and issuing prizes based on the Participant's voluntary consent to data processing (Art. 6(1)(a) GDPR) and the performance of a contract (Art. 6(1)(b) GDPR). Providing personal data is voluntary but necessary to receive the prize. The Participant has the right to:
access their personal data
correct their personal data
withdraw consent at any time
delete their personal data
restrict their processing
transfer data to another controller
lodge a complaint with the President of the Personal Data Protection Office Winners' data may be shared with a courier company solely for the purpose of delivering the prize. Withdrawal of consent for personal data processing by the Participant or restriction of its processing before the delivery of the prize is equivalent to waiving the receipt of the prize. Participants' personal data will be stored for the duration of the Contest and for one month after the end of the Contest, and in the event of filing a complaint – for one month from the date of the final consideration of the complaint. Participants' personal data will not be transferred outside the European Economic Area.
§ 9. COMPLAINTS AND FINAL PROVISIONS
Any complaints regarding the Contest should be reported to the Organizer via private message on Instagram to the account @vandermoon_eu or via email to the address shop@vandermoon.com within 14 days from the end of the Contest. Complaints will be considered within 30 days from the date of receipt of the complaint. The resolution of the complaint will be delivered to the Participant in the same manner in which the complaint was reported. The Organizer reserves the right to delete comments violating the law, good morals, containing profanity, violating the rights of third parties or the provisions of these Terms and Conditions, in particular comments inconsistent with § 5 section 1 of the Terms and Conditions. Participants publishing the content indicated above are excluded from the Contest. In matters not covered by these Terms and Conditions, the provisions of the Civil Code and the regulations of the Instagram service shall apply. These Terms and Conditions enter into force upon publication on the website www.vandermoon.com
