Please note that from 25 May 2018 we apply new provisions on the protection of personal data – GDPR (Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016).

This Privacy Policy specifies the methods of using and protecting personal data of customers who use the website, hereinafter referred to as the ‘Van der Moon website’.

§ 1. Controller of Customers’ personal data

The controller of personal data of Vitberg's customers is Vitberg – Jacek Sikora, with its registered office in Nowy Sącz, ul. Borelowskiego 29, NIP: 734-100-9112, hereinafter referred to as ‘Vitberg’.

§ 2. Method of data collection

The Customer's personal data is provided by the users of the Van der Moon website voluntarily in order to use the services offered by Vitberg through it. Failure to provide certain data may limit the possibility of using Van der Moon website or certain services. The above data is processed on the basis of the Customer's consent granted by checking the appropriate box on the order form and the registration form of individual Customer Account. Vitberg collects Customer data such as: name and surname, email address, delivery address. When the Customer creates an individual Customer Account on Van der Moon website, they may be asked to provide additional data such as a telephone number.

§ 3. Cookies

Using Van der Moon website, the Customer agrees to the use of cookies for the convenience of browsing Van der Moon website. No cookies used on the pages of Van der Moon website collect information enabling the identification of the user. What is a cookie file?

In today's world, virtually every website uses cookies. They are small text files stored on the user's end device. They are created by the user’s browser and store the settings and information needed (and often necessary) for the proper functioning of the website. During the user’s subsequent visit to the website from the same device, the browser can check if there are cookies that store important information and send them again to the visited website that previously saved the cookie on your device. In this way, the website can recognize that the user has visited it before and, for example, adjust the presented content to the recipient.

Advantages of cookies

Cookies help the user to use previously visited websites. If the user uses the same device and browser as before, it enables remembering their preferences and proper display of the website, tailored to their individual needs. Cookies enable creating statistics that help understand how users use the website, which facilitates improvement of its structure and content. They also enable keeping the user's session (after logging into the website), thanks to which each subsequent page of the Vitberg website does not require logging in again.

Most browsers offer the possibility of accepting or rejecting all cookies, accepting only certain types of cookies, or notifying the user each time a website tries to save them. Please note that blocking all cookies may cause difficulties in the functioning or completely prevent the use of some of the website's functionalities.

§ 4. Purpose of data collection

All data provided by the Customer will be processed by Vitberg in order to complete the order and to use individual Customer Account, among others to ensure contact between the Customer and Vitberg. Also to inform the Customer about Vitberg's products, services and promotions and to pursue claims arising from conducted business activity, to the extent that this does not violate the provisions of the Personal Data Protection Act of 10 May 2018 (i.e. Journal of Laws of 2019, item 1781).

Depending on the consent given by the Customer, the personal data provided, in particular the email address and mobile phone number, may be used by Vitberg to send a free newsletter containing commercial information within the meaning of the Act on the provision of electronic services of 18 July 2002 (i.e. Journal of Laws of 2020, item 344). Consent to subscribe to the newsletter may be withdrawn at any time. For this purpose, use the link available in each email sent to our customer with the newsletter.

The Customer has the right to decide to what extent their personal data will be used. In particular, the Customer may submit a declaration of will withdrawing consent to receive the newsletter. The Customer has the right to supplement, update, rectify personal data, temporarily or permanently suspend its processing or delete it if it is incomplete, out of date, untrue or was collected in violation of the law or is no longer necessary for the purpose for which it had been collected, and the right to object, in the cases provided for in the GDPR, also when Vitberg intends to process the Customer's data for marketing purposes or transfer it to another data controller.

Vitberg reserves the right to refuse to delete the Customer's data if its retention is necessary to pursue claims or if it is required by applicable law.

§ 5. Right of Access

The Customer may access this Privacy Policy (or the Terms of Service) at any time via the link on Van der Moon website and print it. Recording, securing, disclosure and confirmation to the Customer of the essential provisions of the contract for the sale of goods and services takes place by sending the Customer’s email address provided and by attaching to the shipment containing the order a copy of order confirmation, order specification and the receipt (VAT invoice). Vitberg declares that it processes the Customers’ personal data in accordance with the GDPR and the Personal Data Protection Act, and that it applies technical and organisational measures ensuring protection of the processed data appropriate to the threats and categories of data covered by protection, and in particular secures Customers' personal data against disclosure to unauthorised persons, loss or damage.

§ 6. Sharing Customers’ personal data with third parties

Only authorised employees or contractors of Vitberg and authorised persons managing Van der Moon website who have been granted appropriate powers of attorney have direct access to the personal data collected by Vitberg.

Vitberg may share the collected personal data of the Customer with cooperating entities such as: courier companies, companies processing payments in order to complete the Customer's order. In such cases, the amount of data transferred shall be limited to the required minimum.

In addition, the information provided by the Customer may be made available to competent public authorities, if required by applicable law.

§ 7. Disclaimer of liability

Vitberg shall not be responsible for the actions or omissions of the Customers as a result of which Vitberg processes the personal data provided by them in the manner specified in this Privacy Policy. Any additional questions related to this Privacy Policy should be sent to
